DOES WORKER’S COMP APPLY IF I’M WORKING FROM HOME?

It can. But like most legal questions and answers, it depends.

In general, employees are covered under worker’s compensation if the injury arises out of and occurs in the course of employment.

In other words, if you are injured while you are doing your job during your work hours, you may be covered under worker’s comp regardless of where the injury happened.

It’s important to know that you have the burden of proving that the injury is work-related, and our current “shelter in place” mandate definitely makes it less black and white.

But if you are injured while doing your job, whether at home or somewhere else, you have the right to file a worker’s comp claim. And if your claim is denied (which wouldn’t surprise me), you should definitely speak to a lawyer.
